The Governor of India forms an important topic for the competitive exams that are conducted across the country. Part VI of the Constitution of India deals with the state executive. The state executive consists of the governor of India, the chief minister, the council of ministers, and the advocate-general of the state. Governor is the nominal head at the state level.  The Governor of India is the state’s chief executive officer. He acts as a representative of the union government. The Governor of  India has executive power over the state, and all executive actions must be made in his or her name. The constitution’s Seventh Amendment, passed in 1956, allowed for the appointment of the same individual as Governor of two or more states.

Appointment of governors of India

  • The SC in 1979 said that the office of governor is not an employment under the central government. It is an independent constitutional office and is not under the control of or subordinate to the central.

 

Reason for adopting this system of appointment of the governor in India

  • Direction elections would be incompatible with the parliamentary system established.
  • Direction election could create dilution.
  • Direction election would be a costly method.
  • An elected governor could be a non-neutral person
  • The system of presidential nomination enables the center to maintain its control over the states

 

Qualification

  • He should be a citizen of India
  • He should have completed the age of 35 years

 

Conventions that have developed while appointing a governor

  • He should be not from a state where he is appointed
  • While the appointment of the governor of India, the president is required to consult the CM of the state concerned

 

Conditions of the governor’s office in India

  • He should not be a member of either house of Parliament or the state legislature.
  • He should not hold an office of profit
  • He is entitled, without payment of rent, to the use of his official residence
  • He is entitled to such perks, allowances, and privileges as decided by the Parliament
  • His emoluments and allowances cannot end during his term of office

 

Immunity

  • He enjoys personal immunity from legal liability for his official act
  • During his term of office, he is immune from any criminal proceedings, even for his act

 

The constitutional position of the governor in India differs from the president in the following ways:

  • While the constitution envisages the possibility of the governor (Art 163) acting at times at his discretion, no such exception has been envisaged for him
  • After the 42nd constitutional amendment act, ministerial advice was made binding on the President, no such provision has been made for the governor so far.
